Terms of Service

Please read these terms carefully before using the ATARise platform. They govern your rights and responsibilities as a user.

Acceptance of Terms

By accessing or using the ATARise platform ("Platform"), operated by ATARise Pty Ltd ("ATARise", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and ATARise, governed by the laws of the State of Victoria, Australia.

Account Requirements

Eligibility

You must be at least 13 years of age to create an account.
Users between 13 and 15 years of age require verifiable parental or guardian consent before account activation.
You must provide accurate, complete, and current information during registration.

Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials.
You must not share your account with others or allow unauthorised access.
You are responsible for all activity that occurs under your account.
You must notify us immediately at support@atarise.com.au if you suspect unauthorised access to your account.

Acceptable Use Policy

When using the Platform, you agree to:

Educational purposes only

Use the Platform only for its intended educational purposes.

Respect IP rights

Respect the intellectual property rights of ATARise and other users.

No disruption

Not engage in behaviour that disrupts the Platform or other users' experience.

No unauthorised access

Not attempt to access restricted areas, other users' accounts, or our systems.

No automation

Not use automated bots, scrapers, or similar tools.

Legal compliance

Comply with all applicable Australian laws and regulations.

Prohibited Activities

Sharing exam content, answers, or solutions outside the Platform.
Impersonating another person or misrepresenting your identity.
Using the Platform to harass, bully, or threaten others.
Attempting to reverse-engineer, decompile, or disassemble any part of the Platform.
Accessing or using the Platform from jurisdictions where it is prohibited.

Content Licensing

Your Content

You retain ownership of any content you create or upload to the Platform. By submitting content, you grant ATARise a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display your content solely for the purpose of providing and improving the Platform.

ATARise Content

All exam questions, study materials, analytics tools, and other content provided by ATARise are owned by ATARise or its licensors. You may not copy, redistribute, or create derivative works from ATARise content without prior written permission.

Intellectual Property Rights

The Platform, including its design, code, algorithms, trademarks, logos, and all content created by ATARise, is protected by Australian and international intellectual property laws. You acknowledge that:

The ATARise name, logo, and branding are trademarks of ATARise Pty Ltd.
All exam content and study materials are protected by copyright.
The ATAR prediction algorithm and analytics system are proprietary technology.
Nothing in these Terms grants you any rights to use ATARise’s intellectual property beyond what is necessary to use the Platform.

Subscriptions and Billing

Free Trial

New users are eligible for a 14-day free trial of the Premium plan.
No credit card is required to start a free trial.
At the end of the trial, your account will revert to the Basic plan unless you choose to subscribe.

Subscription Plans

Subscriptions are available on a monthly or annual basis as displayed on our Pricing page.
Annual plans are billed upfront at a 20% discount compared to the monthly rate.
All prices are displayed in Australian Dollars (AUD) and are inclusive of GST.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
We will send a reminder email 7 days before each renewal.
You can cancel auto-renewal at any time through your account settings or by contacting support@atarise.com.au.

Refund Policy

Refunds are governed by our Refund Policy. In summary, we offer a 30-day money-back guarantee for individual subscriptions.

Exam Conduct Rules

When sitting mock exams on ATARise, you must adhere to our Academic Integrity Policy. Key rules include:

Complete exams independently without external assistance.
Do not use unauthorised materials during timed exams.
Do not share, photograph, or distribute exam content in any form.
Do not use multiple accounts to gain an unfair advantage.

Consequences of Violations

Violations may result in score invalidation, account suspension, or permanent account termination. See our Academic Integrity Policy for full details.

Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

ATARise provides the Platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
ATARise does not guarantee that ATAR predictions or scores on the Platform will match actual ATAR results.
ATARise is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
Our total liability to you for all claims arising out of or in connection with these Terms shall not exceed the amount you have paid to ATARise in the 12 months preceding the claim.

Australian Consumer Law Protection

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded.

Dispute Resolution

Informal Resolution

We encourage you to contact us first at support@atarise.com.au to resolve any disputes informally.

Mediation

If informal resolution is unsuccessful, either party may refer the dispute to mediation under the rules of the Resolution Institute (Australia).

Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria.

Account Termination

Termination by You

You may delete your account at any time through your account settings.
Upon deletion, your personal data will be removed within 30 days, except where we are required to retain it by law (see our Privacy Policy for retention periods).

Termination by ATARise

We may suspend or terminate your account if:

You violate these Terms or our Acceptable Use Policy.
You breach our Academic Integrity Policy.
We are required to do so by law or court order.
Your account has been inactive for 24 consecutive months.

We will provide reasonable notice before termination, except where the violation is severe or ongoing. You may appeal a termination decision by contacting support@atarise.com.au.

Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

We will update the "Last updated" date at the top of this page.
We will notify you via email at least 30 days before the changes take effect.
Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
If you do not agree with the changes, you must stop using the Platform and delete your account.
